under the Interstate Compact agreement. The question I have, is do I still need to complete the remainder of the treatment, 1 year and 8 months? Texas doesn't have an extensive treatment program like WA state does. I've paid all my fees and was in...

    Scott’s Answer

If I understand your question, it sounds like you are on a deferred prosecution. As a practicing DUI attorney in Tacoma, I can tell you that you must complete your 2 year outpatient treatment to be considered in compliance with your Deferred Prosecution. If you do not complete the outpatient program, you will be violated. Its as simple as that. Deferred Prosecutions are granted in Washington only if you agree to complete a 2 year outpatient treatment program.

I don't want to second guess your attorney or your probation officer, but I find it very unlikely that "you are good". I've represented clients in similar situations and you must complete your outpatient program.

  • Can u invoke your 5th ammendment if you already wrote a statement?

If i already wrote a statement and am subpeonad to court can you plead the 5th? Will you be charged with something new?

    Scott’s Answer

Yes. You can always plead the 5th. I agree with the answers given by the other attorneys, you need to contact an attorney immediately. You written statement can be used in court to impeach your live testimony if your live testimony defers. You must contact an attorney as soon as possible to discuss your options.
