  • Can my brothers wife turn over power of attorney to her daughter without his consent

The wife is in the hospital at the moment but she's fully coherent and able to make decisions for herself

    Michael’s Answer

Yes, under RCW 11.94 a Principal may name an agent to act on his or her behalf. A spouse is not required to consent. Here, since the Principal is able to make decisions for herself, I expect the hospital staff will seek guidance from her directly as much as possible.
