My general rule of thumb is you do not need a L&I attorney if everything is going well. In other words, the best you can do is a full pension. If they are going to give you that without an attorney, then you do not need to hire one. However, if there is anything in dispute, an experienced attorney that practices in that area of the law is essential. Also, depending on the facts of the accident, if there is an outside party that contributed to the accident (i.e., not the employee or fellow...

In my state (Washington), this would fall under the intentional tort of intentional infliction of emotional distress. Check with a local attorney to see whether your state has a similar intentional tort.

I agree with the three previous answers with respect to whether or not you have a negligence case against the casino (without commenting upon the implicit sovereign immunity issue lurking there). However, you should check with casino management to see if they have a med-pay insurance provision. It is possible that a form of "no fault" insurance may exist to pay or assist with the medical bills.

I am a personal injury attorney in the state of Washington. However, the following general statements would likely be applicable in your state. I tell potential clients who are learning about the personal injury claims process like yourself that there are basically two parts of the case: 1)Liability or legal wrongdoing (aka negligence) and 2) Damages - which include special itemized damages such as medical bills and lost wages and general damages which are pain and suffering and loss of...

I am an attorney in Washington state but I assume the answer would be the same in your state. You will need to sue the real party in interest which means the driver and you would also want to sue his employer under the doctrine of respondeat superior. However, if you have insurance you may want to turn this in to them and they will fix your car (minus your deductible) and fight with the other side for you. The only problem with this besides your deductible is that this may count as a filed...

I am an attorney in Mount Vernon, Washington so I am answering utilyzing Washington State Law. The only "person" authorized to sue and/or settle a case on behalf of a deceased is the personal representative duly appointed by the court. I would start my inquiry with that person (or people if co-representatives were appointed).

I am an attorney in the state of Washington and thus my answer is Washington State specific. First, in the future at a relative small expense you can purchase gap insurance. Gap is an acronym for guaranteed automobile protection. The purpose of the insurance is to pay any difference between what is owed on the vehicle and what the vehicle is actually worth. With that fact aside, the amount of money you recieve is supposed to allow you to purchase a comparable vehicle. WAC 284-30-3912 sets...

An action must be commenced within 3 years for a negligent act (See RCW 4.16.080). Commenced means the lawsuit must be started by filing the complaint or serving the summons and complaint by the statute of limitation date. (Note, filing and service must be accomplished within 90 days of the filing of the complaint). This statute of limitation will be tolled if you are under 18 years of age. See RCW 4.16.190.
