Referencing a DUI deferred prosecution case in Washington State - When does the 5 yr probation begin and end?

Asked by a user in Kirkland, WA - over 1 year ago.

It starts when the DP is entered by the court and even once dismissed will count as a prior for the seven year period.

Can a felony be reduced in court?

Asked by a user in Bothell, WA - over 1 year ago.

The amount of money detrmines the class of the crime. If it's a Snohomish County felony you may be elliigable for an expiditited felony, which is a gross misdemeanor. You could also have your attorney consider diversion so you get an all out dismissal after three years or less if your diversion counselor recommends it. Call with questions.

How many years can Washington state go back in your records searching for prior dui offenses?

Asked by a user in Mount Vernon, WA - over 1 year ago.

My colleagues are all correct. Check my website because George practices in Skagit snd knows the players. Check my website or call me. The only problem is George Freeman is at the Spence College, which is a huge honour, our office can help until he he gets back and we could get you in touch with him while he's at the college.

If I don't have an attorney at my arraignment will I be able to talk to a public defender before I see the judge?

Asked by a user in Everett, WA - over 1 year ago.

Plead not guilty and don't talk to the prosecutor. Many courts in Snohomish County have Public Defenders. If not, just say not guilty and I'd like to screen for counsel or hire private. Don't discuss your case and don't talk to the prosecutor. It's their job to convict you. Feel free to contact me if you have questions. I saw Johnathon Dichter responded as well and you can call him and he will give excellent advice as well. Talk to a defense attorney and not talk to the prosecutor.

My 16 yr old son was just charged with second degree malicious mischief - what can we expect - best and worst case?

Asked by a user in Mukilteo, WA - over 1 year ago.

He may be eligible for a diversion agreement. Meaning he does certain things, mostlty pay restitution and meet with a diversion probation officer. Other option if the charge is not able to be in diversion there is a way to plead guilty and request a defferred disposition, which is a dismissal after certain terms are meet. It is a felony so the right to possess or own a firearm will be prohibited. If you complete the deffered you still have to get your gun rights restored. Please feel free...
