Is vacation of misdemeanor conviction in Washington State possible regarding guilty plea to RCW 46.61.5249?

Asked by a user in Lake Forest Park, WA - over 2 years ago.

Generally speaking, it appears you are eligible to vacate the Neg1. You must meet the following conditions and the Court does have discretion on whether to grant the motion or not. • It has been at least three years since you completed the terms and conditions of the sentence, including restitution/legal financial obligations. (since the case was closed) • There are no criminal charges pending against you in any court of this state or another state, or in any federal court • You...

Generally speaking, a DUI is where your Driving is “affected by” alcohol, drugs or a combination of alcohol & drugs and/or within 2 hours of driving your Breath Test (BAC) is greater than > .08. DUI’s have severe licensing consequences and penalties including mandatory jail time. You need to hire an experienced DUI attorney as soon as possible to protect your rights. I was Arrested for DUI 2 weeks ago, waited for ticket, instead the bail was released back to my mother... Case Closed?

Asked by a user in Bellevue, WA - over 2 years ago.

This is not all that unusual. The bail was released because they are not bringing charges at this time. (the case is technically closed for now) In King County, charges are typically not filed for 3-6 months or so. (I am assuming this is a State case) They actually have 2 years to file charges on your DUI. You will get notice in the mail of a Court date for your arraignment. (that is when you plead not guilty and the court sets conditions of release including bail, if appropriate) The...

Dui probation time limits

Asked by a user in Aberdeen, WA - over 2 years ago.

The time line is 5 years from the date of sentencing on the 1st DUI. If you were arrested for the new DUI within that 5 year period the Court could set a review hearing to revoke jail time/fines etc. The period will be extended if there are warrants or FTA's (failures to appear) during the 5 year probationary period.

DUI time frame in Washington state

Asked by a user in Puyallup, WA - over 2 years ago.

The Statute of Limitations (time for which charges can be filed) for a DUI is 2 years from the date of the incident. The time frame for charges being filed varies widely among the Courts in Washington State. In King County, 4 months would not be that unusual. Blood cases also tend to take longer to file.

Statute of limitations in WASHINGTON Seattle for DUI

Asked by a user in Seattle, WA - over 2 years ago.

2 years as long as you don't miss any Court dates in the future - which would toll (stop) the statute. (The Court would have to issue a warrant for fail to appear.) You should get notice in the mail of the Court date for arraignment. You usually will get around 2 weeks notice of the Court date. The delay in filing charges is not unusual in King County and typically can be many months. (depending on the Court)
