I need to get a anti-stalking order. Since I found 8 other people that he assaulted, can I present their testomony in court?

Asked by a user in Airway Heights, WA - about 1 year ago.

If you are going in to ask for a anti-harrassment order, evidence of his temperament and disposition is appropriate if you make it clear you are doing it for this purpose. A pattern or course of criminal convictions reflecting this is clear evidence that his behavior is not accidental or mistaken, but rather part of a deliberate and and larger problem of his temper and behavior. That being said, a drug conviction is not the sort of charge that reflects this sort of temperament and...

Would i be able to find out where he is in prison and if he is released early?

Asked by a user in Usk, WA - over 2 years ago.

Department of Corrections (DOC) has an extensive web-cite that will tell you were he is at and what his DOC number is. You could call DOC, or the local prosecutor's office with that information and find out his potential release date. http://www.doc.wa.gov/offenderinfo/default.aspx

Deletion of arrest and non- convicted crime, do i need to physically be there or do i just mail it in?

Asked by a user in Seattle, WA - over 1 year ago.

In three years, pursuant to a statute, you can write a letter to Seattle Police Department asking them to remove the non-conviction/arrest data. You will need to wait three years as that is what the law requires. Sent the letter certified, return receipt requested and if the police fail to take action, it would take very little effort for a lawyer to remind them to follow the law (I have found writing one follow up letter does it), especially if you have proof you sent and they received...

Is there any way a domestic violence protection order harms a military career?

Asked by a user in Maple Valley, WA - about 1 year ago.

If the Protection Order prohibits him from possession firearms, he is right. Under your circumstances, it is within the judge's discretion. Generally: State Law holds the Court shall require surrender of a firearm if clear, cogent, and convincing evidence shows use, display, or threat with firearm or other deadly weapon in a felony or ineligibility of respondent to possess a firearm. Court may require surrender if the above is shown by a preponderance. RCW 26.50.060 (1)(j), RCW 26.50.070,...

With a d. violence harassment charge, under what terms can an soc agreement be in place so that green card is ok?

Asked by a user in Bellevue, WA - over 1 year ago.

The federal case law surrounding this issue is in constant flux. There is one certain minimum rule: you cannot stipulate to the evidence or police report. In Washington, The Washington Immigration Project is a nonprofit and is one of the best resources on this topic. www.defensenet.org/immigration-project They are constantly paying attention to the federal rulings that effect this area of law and many criminal defense lawyers have discussed there cases with them over the years. There...

Should i take a polygraph test?

Asked by a user in Spokane, WA - over 1 year ago.

A polygraph administered by the police is just another word for interrogation: they ask you a series of questions that, oddly enough, will have you giving your whole story without the benefit of knowing what they believe, what facts they have, and, you will not have the assistance of counsel to explain the situation and rules of law that are applicable. Your answers and discussions with the police could be used against you in court however the polygraph results (even if favorable) will not be...

Deferred sentencing on Domestic Violence Charge--am I guilty???

Asked by a user in Tacoma, WA - about 2 years ago.

In order to qualify for a deferred sentence, it is necessary that you admit guilt, but, the "sentence" is deferred for some period of time. Typically between the time of admitting guilt and sentence, you stay out of trouble, complete some conditions and at the subsequent sentencing, the judge withdraws your guilty plea by legal fiction and enters a sentence of not guilty or dismissed. This is what a deferred sentence is. This legal procedure avoids you being sentenced, but does not avoid...

Asked by a user in Redmond, WA - over 2 years ago.

What is city assault in punishable with?

Asked by a user in Spokane, WA - over 2 years ago.

Assault 4th in Washington carries 365 days jail and a $5000.00 fine as a maximum. Generally, assaults in Municipal court mirror the Revised Code of Washington and so a City assault charge is the same as Assault in the 4th Degree. If you have concern it is not, look up the City Codes at: www.mrsc.org/codes.aspx
