    If your boyfriend was not released from jail, the clear implication is he being held aka is serving time on the other charge.

    In respect to the question about consecutive time versus concurrent time, theft 3 is a gross misdemeanor and sentences do not presumably run concurrently on gross misdemeanors. In respect to the defendant not receiving notice of his court dates, while on probation the defendant was obligated to inform the court and probation of his current address--if the defendant did provide the updated address but the notice was sent by mistake to the old address their may be an issue. Based on what you are writing, I am assuming your friend is in jail and not in prison and the 50% good time deduction does not apply to jail commitments.

    Imputed income is normally based on a finding of voluntary underemployment or voluntary unemployment. For example, you agreed to take a lower paying job.

    Many courts will, upon request, appoint an attorney at public expense for a material witness. I think this is an avenue you should explore--at least with a phone call to the administrator that handles public defense appointments in the jurisdiction your warrant was issued from.

    There are good public defenders and there are good private lawyers. Public Defenders often have access to more colleagues and resources than private lawyers. I think if yo get a public defender you like you should stick with that lawyer and if you are not satisfied then you can hire a lawyer.

    The backgroud check conducted by the Washington State Patrol shows both arrests and convictions. You can obtain a application on-line from the Washington State Patrol to delete non-conviction data from your record.

    A finding of committed was made on your case--so under the circumstances it would be very difficult to get the committed finding vacated and a deferred finding entered.

    ADATSA will pay for alcohol treatment if a person is truly needy and needs treatment--so the judge may believe he can get treatment without a job or the judge may think without treatment your boyfriend is not safe to be in the community.

    The arrest should show up on such a background check. There is a benefit to having a case dismissed and depending on the circumstances there is a mechanism, after waiting the required period of time, of getting the arrest deleted from your record.
