Is DUI conviction a felony or misdemeanor

I agree with the previous posts, and would add that there is always the possibility that another's record has been superimposed into yours or that you share the same name and/or date of birth as another individual who has a record and that is how this mistake came about.

My daughter (17) got an MIP. Will we be able to get this deferred? What would that involve?

I suggest you seek some sort of Stipulated order of continuace or diversion for your daughter. As compared to a deferral - where one pleads guilty, does some probation, and pays a fine, etc. - an SOC or diversion does not result in a conviction. Normally, the case is continued out while your daughter would complete some requirements set by the court. Examples would be paying court costs, a fine, community service, perhaps obtaining an alcohol evaluation and following any treatment...

Will the whole order be denied if distanced is too severe??

Not sure I follow your scenario. First, do nto leave out facts, this is what the judge needs to make a finding, so gove the judge everything. An order can be crafted such that a respondent can be restricted from your property and you personally, yet still be able to be on his property, even though he is your enighbor.

When is something put on your record?

The police will always keep a record of her arrest (not public accessed), but most probably, if there was not filing of charges and no conviction, there will not be a "record," as I understand you are asking.
