Description: Plaintiff was riding his bicycle down a residential road. Another driver was pulling out of a driveway owned and maintained by three homeowners (including defendant Smith-Anderson). The bicyclist struck the side of the exiting van and was dead on the scene. The bicyclist's estate sued the homeowners; contending (among other things) that they had negligently installed a convex mirror on a tree across the roadway; and that the mirror contributed to the accident by making the van driver believe it was safe for him to pull out. Defendants retained one of the top bicycle accident engineers in the country, and with his assistance, convinced the court to dismiss the homeowners from the case.
