At motions, the judge dismissed this case after I argued that the officer, who smelled alcohol on my client's breath after the accident did not possess probable cause to arrest my client.

Due to several legal issues in the case, we were able to brief out motions that compelled the prosecutor to amend his charge to misdemeanor DUI, and sentence him to 12 months in custody only.
