You remain liable for the HOA dues until your name is removed from the title either by a sale or a foreclosure. In the past HOAs were not typically suing over past HOA dues; however, that has changed over the past several years. You would need to look at your HOA by-laws, but most liklely the HOA may still sue you. You may be able to work out a payment plan with the HOA. You may also want to contact a consumer bankrtupcy attorney in your area to discuss your other alternatives.
