Expired tabs and no proof of insurance on someone else's car... Best course of action?

Asked by a user in Issaquah, WA - over 3 years ago.

Driving with "Expired Tabs" (Expired Vehicle Registration) is not a moving violation under Washington State law. Washington Administrative Code (WAC) 308-104-160 lists all moving violations in Washington State. It does not list "Expired Tabs" (Revised Code of Washington 46.16.010). In addition, the judge at a "Mitigation Hearing" cannot dismiss the violation; by definition, you admit having "committed" the violation when you request a "Mitigation Hearing", as opposed to a "Contested Hearing"...

Speeding ticket in WA - 16 miles over the limit - $195 fine. should I pay it or defend?

Asked by a user in Auburn, WA - almost 3 years ago.

There is no simple answer to your question. You can "fight" the ticket yourself, or you can hire an attorney to "fight it" for you. An experienced traffic attorney can give you a better opportunity to keep the violation from appearing on your driving record, either by convincing a judge to dismiss the ticket or by negotiating a solution with a prosecuting attorney. You will need to decide how much you are willing to spend to keep the violation from appearing on your driving record. If you...

Deferal program question

Asked by a user in Wenatchee, WA - almost 3 years ago.

In most cases, a "Deferred Finding" (and any probation that accompanies it) begins when a judge signs the order. Many people mistakenly believe that a Deferred Finding begins on the date of the alleged traffic violation. Thus, it is important for you to determine the date on which the judge granted you a Deferred Finding; your probation started that same day. From the information you provided, it is likely that you were still on probation when you received the ticket for "Expired Tabs"...

I have 2 speeding tickets within 6 weeks. Both 12 over on arterials.

Asked by a user in Mill Creek, WA - about 3 years ago.

There is no reason to believe that you will be able to "get rid of one" of your two (2) tickets simply by having both tickets heard on the same court date. The judge's job is to review the evidence presented in each case (by the police officer, and by you, the driver) and determine, on a more-probable-than-not basis, whether the violation occurred. The judge is not likely to dismiss one of your two tickets out of sympathy for you. I have been fighting speeding tickets in and around...

Speeding in school zone..Redmond, Wa..contest ...or not..probably can't defer.

Asked by a user in Houston, TX - over 3 years ago.

You're right - you can't defer this "School Zone" ticket because you may only defer one (1) moving violation every seven (7) years in Washington State. Whether you "have a case" or not will depend on several factors. First, was the "School Zone" speed limit of 25 mph actually in effect? Even though you stated that "school was long over", the speed limit would still be 25 mph if warning lights were flashing on the posted speed-limit sign or if children "were present" (that is, within the "...
