Native American fishing rights

Asked by a user in Washington - over 4 years ago.

On reservation fishing is based on tribal law. Off reservation fishing, if it is based on reserved treaty rights, does not require a state fishing license. For example, most tribes in Washington and Oregon have the right to fish at all their usual and customary fishing places, which includes fishing sites off reservation. However, a member from a Washington tribe cannot fish without a license in Virginia, for example, because it is not part of their treaty right.

Fact Finding interviews

Asked by a user in Neah Bay, WA - about 4 years ago.

If the policies and procedures manual does not specifically entitle an employee to see a copy of a given complaint lodged against them during an internal employment related investigation, then the human resources manager is probably not violating any tribal laws by refusing to give you a copy of the complaint. Tribal law

Asked by a user in Washington, DC - about 4 years ago.

Contact the Tribes Human Resources or TERO Office. Get a copy of their employment handbook and a copy of their employment laws, then contact an attorney practicing near the reservation. If they can't help you, I'm sure they will know of an attorney that practices in the Tribes' court or can become admitted to practice if they feel you have an actionable case. If no local attorneys are willing to assist, call the tribal court clerk and ask if there are any attorneys admitted to practice in...
