    Yes, this queston has been asked and answered previously. What you have described is a civil lawsuit-not a criminal matter. Turn the matter over to your insurer immediately to make sure your default is not taken!

    While it is certainly unfortunate that this happened to you, from the information you provided it does not appear that you sustained much in the way of an injury, aside from the scratch to the roof of your mouth. For the time being I would photograph and save the wire and not release it to anyone else, as doing so runs the risk that it could be damaged or destroyed.     The first thing to do is to demand payment from the insurance carrier. If they dont pay the full judgment they will probably again offer you a pro rata share. Once you accept that reduced sum it is typical to file a document called acknowledgment of partial satisfaction of judgment showing what has been paid. This does not exonerate the defendant for the balance he still owes you.

    You can always retain a new lawyer if you are dissatisfied with your current one. Of course you should consider talking with your current attorney to voice your concerns and find out what his thought process is in regards to the offer that was made. There may be factors he has taken into consideration that he has not properly communicated to you.

    Fault for an accident is not dependent on whether or not you had insruance coverage. If the other party bears fault for the accidnet you can submit a claim to the carrier for the damage to your vehicle. However, if you did not have auto insruance you are not entitled to recover general damages(i.e. pain and suffering) in the event you wer injured. As far as the consequences of not having insurance watch your mail and see if you a citation.

    The question is somewhat confusing in that it states you agreed to a settlement, but later ask how much you should ask for. Apparently you have not reached a settlement as of yet. In order to recover for your injuries you must be able to demonstrate that McDonalds was negligent in its use, management or maintenance of their property. Simply because you were injured does not mean that McDonalds is automatically responsible. The failure to salt the parking lot could indeed be negligent....

    The prior answers are correct. Absent some independent form of negligence predicated on something other than vehicle ownership, your liability is capped as stated in the earler responses. Tender any claim to your insurance carrier.
