    I just handled a similar issue for a client. The respective insurance carriers submitted the property damage part of the claim to arbitration. The arbitrator made a finding of 60/40 on liability. My client then proceeded to court to sue for her personal injuries. At trial the insurance carrier argued that they were only 60% responsible for her injuries. The judge rejected the claim and found the other driver 100% responsible for my clients injuries. Barring additional information not provided in the question, Neither you nor the adverse party/insurance carrier are bound by the prior allocation of fault in the property damage arbitration proceeding.

    Once the check is mailed and received by your attorney the typical process is for you to endorse the check. Your attorney will also endorse it and it gets placed into his trust account. Most attorneys will make sure the check had cleared before issuing you a check for your share of the proceeds. If your attorney receives the check on Tuesday he could probably disburse to you on Friday or perhaps tbe following Monday.

    I agree with the prior response. If the corporation purportedly filed an answer without an attorney the thing to do would liklely be a motion to strike the answer.

    I had an idential case about a year ago. We were able to show that the owner knew about the prior condition of the door. We successfully settled the case with both the landlord and the door company that last serviced the door.

    Geerally speaking you are entitled to the cost of repair or replacement whichever is less. It sounds like you have done your homework and have your paperwork in order. Get on kbb.com or edmunds.com and you can see what those sites have to say about the value of your vehicle.
