Asked by a user in Victorville, CA - 3 months ago.

Who is held responsible ? city?insurance? all I have is liability can they pay for some of the damage on the car?

Asked by a user in Los Angeles, CA - 8 months ago.

If this is a freeway, the road is likely owned by the State of California. The first step is to file a public entity claim with the State of California. You have six months from the date of the accident. Then you can try a freedom of information act request or public records act request to the CHP and CALTRANS for logs, videos, and 911 call tapes of the incident. You can file a claim against the state or a state agency or employee with the State Board of Control (SBC), by delivering it to...

Civil Code for Motion to Quash.

Asked by a user in San Francisco, CA - over 1 year ago.

All forms of discovery can be used, if used properly. So the subpoena can be served while motion pending. If you want to file a motion to quash the subpoena you can do so within the time lines. Talk to an attorney to make sure you don't miss any deadlines. If you file a motion to quash and lose you could be subject to pay sanctions/attorneys fees. Call a local attorney to learn your rights and responsibilities, i'm a California attorney. Timelines exist. The response does not create an...

Do I still have a chance?

Asked by a user in Los Angeles, CA - over 1 year ago.

If you already filed a motion to set aside the dismissal then you need to appeal or take a "writ" If the time has run for that to occur then you need to take all your documents to an attorney for review if there is any other possibilities for you.

Is the notice requirement for a rescheduled deposition the same as an original?

Asked by a user in Los Angeles, CA - over 1 year ago.

Typically you waive your objection if not made 3 days before the deposition, so put all your objections in writing. Rutter states "written objection must be served before deposition: Any error or irregularity in the deposition notice is waived unless written objections are served specifying the defect. The objection must be served on the party noticing the deposition, and on all other parties who received such notice, at least 3 days before the deposition. (If made on the third day preceding...

The other guys insurance is not paying the total lost caused by their policy holder.

Asked by a user in San Pablo, CA - almost 2 years ago.

Your father can sue them in small claims or regular court. He can show up with you and you can do all the talking. Talk to a lawyer to help you prepare for the small claims court and if the amount is under $7500 you can sue in small claims court. Sue the person not the insurance, if they lose they will have to pay.

Do I have a case?

Asked by a user in San Francisco, CA - almost 2 years ago.

Contact an employment attorney in your area. Prepare a good chronology of events so you can remember everything to go over with the attorney including all work reviews they had given you in the past and any letters or documents from them regarding the termination. Act quickly because timelines are strict.

Can police take witness reports after an accident from someone with a concussion?

Asked by a user in La Mirada, CA - 8 months ago.

The authorities can take a statement from anyone who will talk to them. Of course you can challenge this later in the proper forum stating you were not in control of your faculties at the time. Also the physical evidence may or may not support the findings in the police report. Get a personal injury attorney to help you.
