  • I hit a tire left in the middle of the road, is the state responsible?

I was driving on the 10 at about 1:14am and hit a tire that was blown and left in the middle of the road. It tore apart my bumper, fender and head light. There was debris everywhere and I feel like the state has neglected that area completely!

You should contact a local injury attorney who has a history of success against Governmental entities like the state.

If you have insurance your carrrier should deal with this issue. If you didn't have insurance then you may have an issue. From the way you describe the incident, you were barely backing out, and usually its the person who is driving who must pay attention to people backing out. So it sounds like the other driver could have and probably should have slowed and let you back out. If you have any injuries you may want to contact a qualified injury attorney in your area to discuss.

You need to seek out an experienced Trial attorney who has a track record of suing Depuy. There are known class actions nation wide, but you may be better served by local trial counsel who has a track record of winning these specific types of cases. You may search online and google Depuy trial attorneys. You need to hurry and find an attorney because there are strict time limits that if missed can stop you from being able to pursue justice.

  • How can I stop someone from posting degrading comments about me on a public internet page?

My boyfriends ex wife is posting derogatory and actions of violence she would like to do to me on an internet page

    Jesse’s Answer

This is a frustrating issue to deal with and maybe not an issue for an attorney. If you bring attorneys into this situation you may end up spending considerable time and money and in the end you may not be happy with the result. If you are seriously scared for your safety then I agree you should print the posts and bring those to the police in your area. They may choose to prosecute her. If you do decide to seek civil justice you should find an attorney who will take your case on contingency. This may not be easy to do unless the ex-wife has assets. The best solution may involve trying to communicate with this person to get a peaceful resolution and ask her to remove these posts. Give her some time and she may come around.

    Jesse’s Answer

I'm sorry to learn of these facts. If you choose to pursue this you will have to deal with MICRA and the time limits imposed to bring suit against a health care provider in California. Most medical negligence lawsuits must be brought in California within 1 year. There are limited exceptions to this, so you should contact an attorney who does Med-Mal in your area. Good luck.
