Assuming your case does involve negligence, it's very likely the local judge won't ask you to cite to a statute. The judge will want to help you resolve your claim so when you arrive in court you should have any documents, paperwork, and bills ready and be able to clearly and coherently explain your case. The judge will listen and he will be looking for negligence. Someone posted the elements of negligence on this thread so you can review. If you have injury such as broken bones, scars, burns,...

Your question is incomplete, so you need to provide more clarity. But let me start with this, if you have a family member who is deceased from a car accident, you should contact a local personal injury attorney in your state. The issue you may have with getting an insurance company to accept liability under separate policies will need the help of a skilled lawyer who can discern whats what. If there is a wrongful death case, then the policies that can be accessed should be carefully reviewed...

First I am sorry to hear about your tragic loss. This situation is more frequent than you would guess. The local papers usually only report what is released by law enforcement, and in certain cases where there are fatalities, and where possible criminal charges could be involved, or CHP's special unit called MAIT is involved they will not release any info from the investigation to family or friends, or the public. It is very frustrating. You may want to consult a personal injury attorney to see...

Find an attorney who deals with Car Accidents in Whittier. The case will likely be litigated in the jurisdiction where the accident occurred, and a local attorney who deals with auto accident litigation day in and day out will be able to help you out. Your lawyer should send a letter to the at fault drivers house and let him know that he needs the insurance info to file a claim. If the at fault driver still refuses, then your lawyer should file suit and serve the suit along with a letter...

You will need to wait until you know what the future holds as to the scarring to determine the value of your case. If you retain a personal injury attorney they will gather your medical records, police report, medical bills, obtain any photos of the accident, damage to your vehicle, and your injuries. During the healing process you need to document your burn as it changes by taking close up photos. Take daily photos, or at least every other day. The value of your pain and suffering damages both...

Yo may be sued. Does she have an attorney? The value of her settlement will be based on her injuries and the amount of your policy limits. Because there are multiple people who are injured and bringing claims she may be capped at how much she can recover. However you may tell your carrier to simply pay it and be done with it. You can let them know this is causing your stress and you do not want to be sued. Sometimes this can help the carrier pay.

This is a very tragic event you are describing. You mention this is a suicide, however I would suggest you obtain a copy of the police report detailing this case. You may want to obtain this report and determine what the cause of the collision was determined by the police or investigating agency. I would also question how you are sure this was suicide? I think you may want to consult a local attorney to share these details with in the county where this occurred. Most personal injury attorneys...

You need to call your insurance company for your vehicle and put them on notice. Since you are aware you are being sued I assume you have been served or at least put on notice by the Motorcyclists attorney. You should provide what ever documents you received to your carrier. If you were actually served with the lawsuit you usually have 30 days to file an answer so time is of the essence. If you do not have insurance, you should find a civil attorney in the county where the lawsuit is filed, who...
