    Miss Stena's answer is spot on. He will be charged with California vehicle code sections 23153a and 23153b at a very minimum. It is likely that these will be charged as felonies even though this is a first offense for him. As part of any sentence he receives RESTITUTION will be ordered to cover all victims financial concerns. This is not a civil recovery but restitution ordered as part of a criminal conviction.     Sealing arrest records can be accomplished if you are a minor or if there was a factual finding of innocence. The fact that the 273 was expunged does not mean it was simultaneously sealed. The latter is difficult to accomplish. In San Joaquin county the DA opposes all sealing cases. Good luck. Hope this helps?

    Yes . Call the District Attorneys office that is charging the drunk driver and they can order that person to pay restitution for the damage to your sons car. Call the m immediately and notify there victim witness unit of your damages. You could also file a small claims action but the D. As office restitution is preferrable to the latter. Good Luck

    I agree with Mr. Leroi. This is an open ended question that lacks facts enough to make an informed judgement on. Any lawyer that promises you an outcome without having discussed and read the police report with you is lying. Lawyers don't do that.     You will need good grounds to be successful if you file the plea to withdraw. This is tricky because you might end up with a far worse result. There are time limitations so don't stall if this is your intent. Do not proceed without consulting with your prior attorney if you had one or whoever you decide to hire as your new attorney. Be careful and definitely consult with a local attorney before you do anything.

    Other than signing a consent form means you consented to the blood draw which is good for DMV purposes. Hopefully you or your attorney signed up within 10 days of the incident for your DMV hearing or you have waived that. Still this is not a refusal DMV case where you would lose your license for 1 year. They have your blood and it has been sent to the DOJ depot of justice lab for testing.
