Can someone win a personal jury settlement and after the contingency lawyer fees and medical fees be left only with damages mone

Asked by a user in San Jose, CA - about 3 years ago.

I'm not sure what you mean by "only my damages money". You are entitled to recover your economic damages (medical bills, wage loss, and other out-of-pocket losses) and your non-economic damages (commonly referred to as pain and suffering damages). In most settlements, after payment of attorney's fees and costs, you should be left with a substantial portion of the settlement. An exception would be if you have liens against your case, such as liens from medical providers or others who have...

What can we do to contest accidental damages incurred by minor in car accident in CA state

Asked by a user in Woodland, CA - over 3 years ago.

First, if you checked with your car insurance company, they would not cover it because the damage did not arise out of the use of your vehicle covered under your policy. As previously indicated, you are legally liable for damages caused by your minor child. However, look at your Homeowner's or Renter's insurance policy for coverage here. Virtually all homeowner's policies have personal liablity coverage, which should cover this incident, since it does not arise out of the use of your vehicle....

What elements are necessary to bring a libel/slander lawsuit in CA

Asked by a user in San Jose, CA - over 3 years ago.

In order to have a cause of action for slander, or defamation of character, you must be able to prove malice. That is that the store manager intended to injure you or your reputation. In certain instances, malice may be inferred, such as where he accused you of a crime and the accusation was overheard by someone else. Defamation is a difficult case to sustain in court, as there are immunities that may apply to protect the store manager, and you have to prove either physical injury or damage...

Need help filing personal injury claim in CA

Asked by a user in Campbell, CA - almost 3 years ago.

You should submit your medical bills to your own health insurance as they will be processed more quickly that way. Then, both the landlord and the plumbing company should be put on notice of your claim, which will be handled by their respective insurance companies. I agree that you should not give a statement, recorded or otherwise to anyone other than your own insurance company. If you need help with your claim, you can contact my office for a free consultation at (408) 295-2100.

What are my rights and how much can I sue in a dog bite case?

Asked by a user in San Jose, CA - about 3 years ago.

Assuming you didn't provoke the dogs, the owner is absolutely liable to you for damages. You are entitled to recover your medical expenses, any wage loss, and any other out-of-pocket expenses, plus damages for pain and suffering and any fear, anxiety, disability or scarring caused by the bites. All of your damages should be paid by the dog owner's homeowner's insurance. If you need assistance in prosecuting your claim against the dog owner, call my office for an appointment. This is one...

Help or Advice. Please help!!!

Asked by a user in San Jose, CA - over 3 years ago.

If your girlfriend has Collision coverage on her own insurance, she can get her car repaired and paid for by her own insurance. They will sometimes tell you to go after the insurance of the person who caused the accident, but don't let them get away with that. She pays premiums for collision coverage, and they should just fix the car. She will have to pay her deductible. If she doesn't have collision coverage, she can try to check on the DMV website to see if she can get a name and/or...
