I take it you've already given the insurer a statement and full access to your medical records. If that's the case, you might still try to negotiate a better deal to see where the insurer will go. Can't give you value with the little info you provided, but considering a significant impact, the insurer does seem low. Remember...it is a negotiation, so they won't open with their best number.
$150K sounds low to me. Of course, we would need to know more to accurately assess this case. However, a fractured femur in a 12 year old with 2 surgeries and a drunk driver certainly seems worthy of more than $150K if handled properly.
There is no slander if the statements you gave are factually accurate and a reasonable person would not believe them to be otherwise. In other words, you can state your opinions that he is a douche (obviously not a fact) and that you would never buy from him. If the rest is accurate, you should be safe.
Depends on your state, but generally speaking, it cannot be used in court. There may even be criminal penalties associated with the recording if the others involved in the conversation had reason to believe it was confidential.
