    It is very unfortunate that your daughter was not watched more closely. However, in order to sue someone you generally need damages. I cannot tell what your monetary damages would be. It appears that it probably freaked you out and caused stress, but it is hard to say that any Judge or Jury would award you money for a single isolated incident. To prove negligence you must prove a lack of reasonable care. One would have to review what the school knew to figure out if there is a claim. Either way, it appears that fortunately no one was hurt. Keep in mind that school sometimes have special administrative procedures and time limits to follow.

    If the lease was written, but then you agreed to modify it by letting him out with 30 days notice, then it appears you guys have agreed to the termination of the lease. You also have a duty to try to find a new tenant (which obviously you want to do anyway to keep your place rented out). If he handed over the keys, then you can go clean it up. If not, then you need to file an unlawful detainer. Best of luck.
