  • How to freeze a bank account in California

D defaulted on $20K loan. I think I was defrauded so I want to freeze D's bank account to avoid it being depleted. To do so I understand that I have to file a complaint and then file AT-105, AT-115, AT-120, AT-125, AT-135, At-160, and AT-165. Is...

    Nicholas’s Answer

This cannot be answered in a yes/no format. Filing a complaint requires multiple documents and many requirements that cannot be explained in a post. Attachments also have many requirements which are very technical. You need to retain an attorney to review all of this, otherwise you can attempt to file it yourself and see how it goes.

    Nicholas’s Answer

You may want to see if you can get their phone number (if they call from just one phone number) blocked. They should stop calling you if you tell them to stop calling.

    Nicholas’s Answer

You need to consult an estate planning attorney who handles probate or trust administration. You can ask that attorney what the fees should be and if you can give them all of the information they can explain how they charge, etc.

  • Can a collection agency reposses my car?

I paid for almost 5 years the balance on the loan was 500 dollars. I lost my job and could not make the payment. the bank told me they were going to send it to a collection agency with they have.

    Nicholas’s Answer

If the loan was properly secured and you defaulted, then it is possible. I suggest you find a way to get $500 as the car is probably worth more than that (I'm sure you know whether it is).

  • I am being followed by a number of different cars and white vans,I see undercover and marked police cars everywhere I go.

If I pull into a parking lot a cop will be there and one min before I leave it leaves.I hear cb radios all over my naborhood.pull I'm most positive that my place is bugged.I hear the people upstairs talking about what I'm doin,if I go in one room ...

    Nicholas’s Answer

Unless you have a criminal record or are conducting illegal or suspicious activities, it is doubtful that people are following you. Radios are very common and cops often have to go around neighborhoods, it may have nothing to do with you. If you have some people who live around you doing illegal activities, maybe that's who they are after.

  • If your landlord comes in the middle of the night, with out any notification whatsoever and boards up your windows so that you

cannot see out of them much less who is at your front door, would this be deemed harassment?

    Nicholas’s Answer

Usually, landlords should give notice before disturbing you unless there is an urgent repair. If you see the landlord coming in the middle of the night, I would write to him and ask him to stop doing that and to give you notice before visiting the property. If he/she does it again, then I would call the cops to report what he is doing.

You need a lawyer who is familiar with medical licensing and regulations. Call the LA County Bar Association (you can Google that) and get a referral. You should consult an attorney to determine your rights and options and promptly.

  • My friend's neighbor is complaining about the music noise. Is it there a certain level of music or time he can paly?

My friend has a private studio in his room at an apartment where his friend and he make music in. He restrict the time to play the music between 11 am and 6 pm, but this neighbor works overnight so he's complaining about the noise during the day ...

    Nicholas’s Answer

There are questions as to whether this music studio is authorized by local zoning/use regulations. If it is not, then it may not be appropriate to have a studio there. Regardless of the law, you should try to find a way to work this out without the law. It would be hard to believe that this studio would be worth the hundreds or thousands to prove your rights in court. If it is, then find another place to live.

  • CA housing LAW?

when tenant has lawsuits against landlord , does land lord has right to cut off all untilities?

    Nicholas’s Answer

A landlord is not allowed to cut off power, electricity or other utilities just because there is a lawsuit. A landlord cannot turn off these items until he has taken legal possession, which is either through the tenant choosing to move out, or an eviction.
