Is it legal for an insurance company to include, in a deductible, their investigative expenses regarding a property damage claim

Insurance policies are complex documents that even experienced attorneys often have difficulty understanding. This question cannot be answered competently without having an attorney review the policy and the correspondence with the insurer. However, the duty to repay expenses incurred by the insurer in order to satisfy the deductible in a special event policy is somewhat unusual. Auto insurance policies include the obligation of the insurer to provide an attorney to defend you in a covered lawsuit. If your insurance company said "they will handle it," they probably will, but you need to follow up with them to make sure they have hired an attorney to defend you and you need to follow up with that attorney as well, immediately.
