  • Divorce & Custody

    Practice Area:
    Child Custody
    Date:
    Jul 15, 2008
    Outcome:
Mother obtained sole legal and physical custody
    Description:
Father had substance abuse issues and was reluctant to get treatment. I produced evidence to demonstrate the extent of this person's problem. I further helped craft a plan, and obtained court orders whereby father had limited visitation rights in order to protect the child until adequate progress was reached in rehabilitation. Upon receiving appropriate court orders, the family began to make progress to restore a more positive environment for the child.
  • post dissolution child support case

    Practice Area:
    Child Support
    Date:
    Apr 10, 2005
    Outcome:
    Arrearage claim settled
    Description:
Father was alleged by the county to owe approximately $65,000 in back child support based on a child support order that was nearly 20 years old. The children were now adults, and they were not seeking any support arrears. Two thirds of the alleged arrearage amount due was interest that had accrued for nearly 20 years, although Father was receiving no notice that an arrearage claim was outstanding. Father paid support during the time when the children were minors, but because the case was so old, he no longer had all the records showing his prior payments. The county took action against Father without proper notice, violating his due process rights, including wage garnishment, suspending driving privileges, and causing a negative credit rating. I demonstrated such due process violations, and had all negative actions against Father reversed. I then had the case transferred to the appropriate county, whereby I got the arrearage claim reduced to a small fraction of the original amount that was alleged due.

  • premarital agreement

    Practice Area:
    Marriage & Prenuptials

I drafted a premarital agreement that protected the clients assets in the event of divorce
    Description:
Client was marrying for the first time at an older age. He had significant wealth, including several rental properties. He also owned his own business. He wanted to ensure that the rental properties would remain his separate property, and that the rental income received during marriage would not be community property. He also wanted to preserve the separate property characterization of his business after marriage.
  • divorce mediation

    Practice Area:
    Mediation
    Outcome:
    divorce finalized without litigation
    Description:
This divorce involved issues of custody, high value community property division, and spousal support. There was infidelity in this marriage, hence there was a fair amount of tension involved during the mediation sessions. However, I was able to help the parties properly vent their feelings so they could keep focus of common ground on which to establish agreements. I also keep them focused on the goal to avoid a nasty and expensive court battle, saving them and their child enormous grief. It took several mediation sessions, but the parties found common ground on all their divorce issues, and hence settled their disputes without any litigation.
