It sounds like the case is under way and so your son likely has a lawyer by now. Talk to his lawyer about the OR issue. That issue is very fact specific and only the person handling his case would know the likelihood of that. Some of the things the court considers for bail reduction/OR release are the ties to the community, public safety and flight risk. Good luck.

Domestic Violence convictions can have serious immigration consequences, even when they're felonies. Much depends on what the offense that the conviction actually ended up as. You'll need to discuss the immigration consequences with an immigration attorney to find out the consequences of your specific conviction. A restraining order is a civil order from the Court. Violating a court order is a misdemeanor offense. If he is on probation for domestic violence and is found in violation of the restraining order or criminal protective order it can be the basis for a new criminal offense and a violation of his probation, even if his girlfriend/wife says it's okay for him to be around him.
