  • Dhir v. Gupta, et al.

    Practice Area:
    Business
    Date:
    Aug 13, 2008
    Outcome:
Summary Judgment in favor of my defendant clients.
    Description:
An individual sued a religious temple and several members of its management, alleging various violations of the Corporations Code, civil rights violations, fraud, and other claims. In the first stage of the case in federal court, I got the case dismissed with prejudice. In the second stage of the case, I obtained summary judgment for my clients. I also obtained thousands of dollars in sanctions against the plaintiff, for filing frivilous motions. I then succeeded in having the court declare the plaintiff a "vexatious litigant" (which prevents him from filing in any CA court without permission of the presiding judge).

    Settlement after summary adjudication

This was a complicated case in which General Motors tried at several junctures to escape liability (the case also coincided with the bankruptcy and reorganization of GM). In the end, however, the court agreed with us that the car was defective "as a matter of law". As a result, a trial was not necessary and the case promptly settled.

    Mar 27, 2006
    Outcome:
Monetary Settlement with Correction and Apology
    Description:
In this libel case, a conservative publisher writing a book critical of Jesse Jackson defamed our clients by linking them to criminal activity. While cross motions for partial summary judgment were pending, the parties settled the case for $600,000. The defendants also wrote a letter of apology and agreed to issue a correction of the inaccurate information.

In this wrongful termination case, the company fired my client (a blue collar manufacturing employee) while he was on medical leave for a hand injury. We sued on various grounds, including disability discrimination and retaliation for exercising his rights to medical leave. The case settled for $300,000.

My clients were African American employees of a property management company.
