    You need to document all of the damage and have an expert opinion as to the cause of the damage. Also obtain repair estimates. The contractor should have insurance assuming the damage was caused by the contractor.

    There is "non-profit" or "not for profit" corporations that can be formed. It depends upon the intent of the organizers and for whose benefit the co-op is formed. More information would be needed to select the right entity, along with advice from a tax professional.

    Not if a default has already been taken, the hearing is likely to prove damages - the amount claimed to be owed. You would need a motion to set aside the default.
