The California restricted license for a first or second offender does NOT include MADD meetings - they'll probably turn you in too - so do tell anyone if you do drive there - Your restricted license is only valid to, from, and during work, or to and from the DUI class - now you might argue going home from work and stopping at the MADD class is to and from and during work, but better not to get caught. After you are off probation, and provided this is a simple first offense DUI, you can apply after that. INS delays any application until you are off probation. You should check w/ INS about a 5 year prohibition, as none of my clients tell me this. Good luck.

The District Attorney of every county in California has up to one year to file a misdemeanor charge like DUI or drunk driving. I think you want an expungement rather than an exemption. Penal Code Section 1203.4 is what you want in California. What you cannot acheive is having it removed from your driver's license record - insurance companies have paid to have it remain on your record so they can charge you higher rates.
