Spousal support that is not part of divorce decree

In order for the support to be tax deductible you must have the specific amount you are paying set out in a court order. If it is not in a court order then you cannot deduct it. I would recommend you get an attorney to establish the amounts you are paying as support order so that you can deduct it. If you are currently paying by agreement then I would prepare a written agreement with your spouse called a stipulation that you could then submit to the court to have signed by a judge thereby...
