When an employee is injured on the job, workers’ compensation insurance provides for medical care, replacement income, and long-term disability treatment if necessary. Workers compensation is generally an exclusive remedy available to an injured worker except when the worker is injured by someone other than an employer or co-worker. Since the cause of your injuries was the result of a negligent driver (not an employer or co-worker) you have a cause of action against that driver not only...

I assume you had insurance coverage on the vehicle you allowed your friend to drive and the only issue is the damage to her car. Your say your neighbor is understanding and wont' sue but if her vehicle was damage she will probably seek compensation. If you have insurance, your neighbor should make a claim against your insurance company and as stated above, if the insurance company determines that your friend is not covered, then your neighbor can pursue a claim under the uninsured motorist...

There are several things to consider, the first is whether you have the income requirements to file a Chapter 7 bankruptcy. In order to qualify under a Chapter 7 bankruptcy, you must take and pass the means test, that is you have to show that your average income in the six months before you filed either was less than the median income by family size in your state or that, if it was higher, you do not have enough disposable income, after paying allowed expenses, to pay off your debt. You...

I assume she has listed your debt on the Chapter 7 bankruptcy petition and you received notice as a creditor? If so, you should attend the Creditor's Meeting tomorrow and ask her why she can't pay the money she owes you. The debtor will be under oath and has to answer truthfully. You should also contact a bankruptcy attorney and inquire about filing a proof of claim. The claim will need to be filed within 90 days of the meeting of creditors. The proof of claim is your evidence that a debt...

If you are asking if you have a personal injury claim, you would have to provide more facts. You listed your questions in a slip and fall forum so I assume that you slipped, but you don't say what caused you to slip (substance, object or otherwise) or where you fell (parking lot, store, sidewalk). You should contact a personal injury attorney in your area. A personal injury attorney will evaluate all aspects of your case and explain all options available to you. Best of luck to you.

Unfortunately, the answer is no. Not only can you not record a mechanics lien you can't sue for compensation of the work performed. As Mr. Chen indicated above, Business and Professions Code Section 7031(a) clearly states: “…no person engaged in the business or acting in the capacity of a contractor, may bring or maintain any action, or recover in law or equity in any action, in any court of this state for the collection of compensation for the performance of any act or contract where a...

The facts stated are a bit confusing. I am not clear as to whether you owe 1 or more than 1 credit card and whether the lien you have is as a result of the unpaid credit card balances. In any event, you should contact a bankruptcy attorney in your area as soon as possible. That attorney will be able to look at your overall financial situation and be able to determine the best course of action for you. Most bankruptcy attorneys offer free initial consultations. Good luck.

  9. If I have a settlement in a different state is there any way i can petition from the state i am in now or do i have to go back?

I agree with the prior answers. If you have an attorney he/she will instruct you and any settlement funds can be received by mail. However, depending on the amount, and if a lawsuit was filed, the court may order the money be deposited into a blocked bank account or placed into an annuity until you attain the age of majority. Either way, you will be able to have access to those funds from any state you are residing at that time. Good Luck.

  10. Am I liable for car accident personal injury because my name was on the title? If so, what type of attorney do I need?

You may still be liable because you were a co-registered owner of the vehicle. An vehicle owner may be liable for the negligent operation of a permissive user, in this case your 16 year old daughter. Additionally, you indicated that Progressive has already paid the policy limits. That means plaintiff's attorney is seeking additional compensation from you directly. You should contact an attorney to defend you in this action as this is a complicated matter and you cannot fight this on your own.
