    If you we're arrested DUI and you had been involved in an accident the CHP is within their rights to collect under the law. Odds are you will not be sued, however the State may wait until you have a State payment coming to you and instead take that payment themselves for your "debt" since that is much easier than suing you in court where they might lose. You would then have to sue them which would be difficult. The "debt" may also mess with your credit rating so you may need to advise them...

    Well the FTP fine and failure to complete the DUI class are not much of a demonstration of your responsibility traits are they... and the failure to complete the DUI class should have resulted in a continuing suspension of your driver's license, even up to today! Hint... Clean it all up! No one will be impressed that for the last five years you haven't been caught driving on a suspended license everyday!!     The officer's should not have taken your license the night of the arrest... if that happened it was done in error and will be returned to you by DMV. If you are convicted of DUI you are looking at a six month suspension however if you have an SR22 on file with the DMV and are enrolled in the correct DUI class you would go down to DMV and immediately be reinstated. This area of the law is extremely complicated, I'd suggest legal help.

    Not sure what you mean by "passed the breath test" but if you mean that your BAC was less than the .08 legal limit then the DMV will give you your license back once they figure that out. There is really no failing of the field sobriety tests, it is not pass / fail... it is just a bunch off clues that may or may not mean anything depending on circumstances. And no matter what, the tests are designed for failure except maybe for the cops that invented them. How often do you stand around like...

    The .08 that you saw on your Promise to Appear in Court was a reference to Count 2 of the the two charges against you... CVC23152(b) Driving With A BAC of .08 or Greater... It was not your actual Blood result. That takes the State lab a few weeks to get the result back into the system. Just thought you'd like to know, and that you are not the first one to ever think that it was your result!

    Unless you are under 21 you can generally refuse the initial, prior to arrest field sobriety tests including the preliminary breath test. If there is a jury trial you may have to explain why you refused the FSTs as the DA will argue that you refused based on your consciousness of guilt. That said once you are arrested on a DUI you would be told that you must submit to either a breath, blood, and possibly urine test to determine your alcohol or drug content.     You'll probably get as many answers from DMV as employees you to speak with... you're going to have to complete the class in order to get your license. sorry but you may also need actually need the SR 22 in place for three years... if not well good on you.
