There is a huge difference between driving on a suspended license and driving without a license. I definitely recommend consulting with a locally experienced DUI or criminal defense attorney. You may want to call the DMV mandatory actions unit at (916) 657-6525 to inquire about the status of your license, and I would definitely recommend doing whatever it takes to get your license reinstated. Ultimately, it is up to the prosecutor as to what charges will be filed against you, not the winking...

In addition to the original sentence, you've also presumably have a warrant for your arrest and a number of probation violations for failing to fulfill your obligations. Assuming your case is in Santa Barbara, the Court is not great at keeping records that old. You'll need to hire a locally experienced DUI attorney to look into this for you, and then ultimately get your case on calendar to get the warrant(s) recalled and work out a disposition with the district attorney. The more you can...

You could certainly be facing jail time, as a result of the second offense, and the multiple probation violations, as well as a host of other penalties. I strongly advise you to retain a locally experienced DUI attorney ASAP, as a DMV hearing must be requested within 10 days. If you don't, after 30 days, due to you still being on probation, your license will be suspended for at least a year with no possibility of a restricted license. Get an attorney ASAP. Jasen Nielsen

A locally experienced DUI attorney will be helpful regardless of your alcohol level. Even though nobody was hurt, prosecutors treat DUI accident cases much more harshly. My advice is to stop posting details of your case online and talk to a few San Diego DUI attorneys. There are many on avvo who offer free consultations. Best of luck. Jasen Nielsen

Generally speaking, if this is your only offense, you should be able to. You also should have been provided a copy of your terms of probation. If you don't have it, call the court clerk to inquire. Good luck. Jasen Nielsen

This is a complicated question that will have to be answered at a motion to suppress, which essentially challenges the legality of the cop's actions. Your friend needs to consult with a locally experienced defense attorney. Best of luck. Jasen Nielsen

Your question is confusing. If you've entered a not guilty plea, then charges have already been filed and he statute of limitations would not apply. More importantly, talk to your attorney, as they will be in a much better position to answer your questions than any of us on here. Best of luck. Jasen Nielsen
