    Getting your license back will almost always ease not just the punishment, but potentially the charge as well. Ask the judge for a continuance in court - while I don't practice in San Bernardino, it shouldn't be a problem. Go back to court with your license. Hiring an attorney will usually help improve the outcome and make the process much easier. If you can't afford one, the public defender can help. Good luck.

    I think you should be in the clear, provided that you are over 21. Based on the DMV set aside, it sounds as if you are. In the event that charges are actually filed against you, I'd definitely suggest that you hire a locally experienced dui attorney. It sounds as if you have a very winnable case if it does get filed.     Only the government can file criminal charges. If the driver had no contact with law enforcement when it happened, then it's almost certainly too late for criminal charges to be filed over the incident. Hopefully the insurance will collect. Good luck.
