I highly recommend requesting the DMV hearing, for a number of reasons. One, if you don't request it and it turns out you have something to fight, it is difficult if not impossible to overturn the suspension. Two, even if the hearing can't be won, requesting it extends your temp license and allows you to plan for the suspension. If it says excluding misdemeanors, then you can exclude the misdemeanor DUI. Summary offenses probably include those without probation, such as infractions like traffic tickets. Good luck.

I agree with the other attorney's answer. Additionally, assuming that she gets probation on the DUI, paying of the restitution would be a condition of the probation, at least in CA. If you haven't hired an attorney on the DUI charge, I highly recommend that you do so. Good luck. Jasen Nielsen

There are a lot of issues here, not the least of which is the felony charges. Most attorneys offer a free consulation. I highly suggest using avvo to find couple and giving them a call to explain the situation in more detail. Some attorneys may offer a military discount, and some will offer affordable payment plans.
