It will stop soon enough - most likely within the next couple of days. There is really nothing you can do to stop them at this point. Try not to worry about this, and let you attorney handle your case. Best of luck. Jasen Nielsen

If your BAC was .0127, you don't need an attorney unless you're under 21 or also had drugs in your system. If your BAC was instead 0.127, you should definitely hire a locally experienced DUI attorney. Best of luck. Jasen Nielsen

  3. How do I get the DUI blood test result from DMV (prior to DMV hearing) by myself, not through attorney or public defender?

Assuming you requested the DMV hearing within 10 days of arrest, and that DMV has your current address, they will send it to you in the mail. However, many of the labs performing the blood tests are back logged, so there's no telling how long it will take. The DMV hearing will not happen without the blood test result. In the event that it comes in under .08%, you won't get the result - you'll just get a set aside of the suspension from DMV. Not sure why you're waiting for blood result to hire...

Possibly, particularly for the alcohol school, as both are conditions of your probation. I definitely suggest that you put your case on calendar ASAP and explain your financial situation to the judge. Don't delay - you're much better addressing this with the court before it becomes a problem than waiting until you are faced with a probation violation and possible warrant. Good luck. Jasen Nielsen

Tough to say without knowing the facts of your case. But the fact that you're set for trial does not mean that you can't still reach a plea bargain. In some cases, the offer from the prosecution will improve once trial approaches. Talk to your attorney. Good luck. Jasen Nielsen

To an extent, it depends on the nature of a case and the stage that the case is at. For example, if the case is set for a contested hearing such as a trial or a prelim, changing attorneys can cause delays, which judges are not generally a fan of. The largest downside is the fact that you'll presumably be paying more than one attorney. Good luck. Jasen Nielsen

I agree that not failinig to complete traffic school does not cause one to be arrested. Perhaps there may have been a failure to appear at court on an unrelated case?

Without having the advantage of reviewing every aspect of your case, it certainly appears to me that you have a case worth fighting, especially considering the lack of a driving pattern associated with a DUI. As for the blood split, if the PD is for some reason unable to obtain the funds, it is not every expensive to have your blood tested by an independent laboratory. Based on the information you've provided here, I would suggest being prepared to pay for the blood split in the event that the...

Not all breath tests offered in the field are PAS test, and he may have provided an evidential breath test sample with a portable device. I would certainly suggest consulting with a locally experienced DUI attorney to review every aspect of your case. Hiring one will give your husband the best chance of beating the case and/or mitigating the charges and punishment he is facing. Good luck. Jasen Nielsen
