Your ex-husband cannot sue your boyfriend. He can take you to court to ask for an increase in child support. If you are unemployed, you should have taken your ex-husband back to court to DECREASE child support that you pay. You still can. Your money -- the money you yourself earn -- is the only money accessible to your ex as child support. If you earn nothing, he can access NOTHING. $600 a month for Prep School is discretionary, and if you don't care if your son goes to Prep School or not,...

If he shows up with the police and a court order, the police will read the court order and ask you to give child to dad. You may present them with declarations from the coaches and police officers regarding your child's attendance on the weekends dad has her. Most likely the police will say take it to court and get it worked out there because they can only deal with court orders, but they MIGHT say that to dad and not to you. If your modification for CS (which I am assuming is what you mean...

Replies are not required. You should be allowed to argue the issue at your court hearing. As for the items not addressed in the venue request, to the extent that they are entirely separate (child support or attorney fees for example), he should not be able to have those addressed. Courts are supposed to limit discussions to the matters addressed in the moving papers.

The bankruptcy court wants to see all debts and wants them lumped together whether they are dischargeable or not -- the Court is well versed in sorting through debts and getting them all in the proper category. 7. Two CA mortgage loans both with the same lender. Can the lender sue for the second loan if we shortsale or go through foreclosur

    1 lawyer answer

This all depends on the timing of the loans. If you purchased the house with one loan or with two loans but later refinanced the second, then the second is NOT a purchase money mortgage. The term purchase money mortgage refers specifically to the purchase of the home for which the mortgage lien is placed -- it is not transferrable. It appears, however, that the second loan was taken well after the first and not used to purchase the actual home on which its lien sits. Under the facts as...

Your boyfriend wasn't actually arrested, right? One option you have is to file a restraining order against this man if you know who he is. This would both protect you and establish a court record of what you say happened in this case. Just because the police have essentially ticketed your boyfriend doesn't mean he'll be found guilty or arrested. He needs to show up at the court date -- it would be helpful to have you with him as a witness. If anyone else was around who witnessed the goings...

  10. Can I get my security deposit back if I never moved into the unit and the landlord was able to re-rent the apartment?

    Answered almost 6 years ago.

    1 lawyer answer

There is some information missing in your scenario -- specifically the amount of rent you were to pay each month, and the move in date on your contract. That aside, here is one attorney's view: If the amount you would owe in rent from the day your contract said you would take possession until the new tenants rented the apartment sometime in September is greater than your deposit, you are not due any of your deposit (monies owed for rent can be taken from the deposit). If that amount plus...
