  • People v. Michael Baker (Residential Burglary)

    Practice Area:
    Criminal Defense
    Date:
    Feb 05, 2010
    Outcome:
    All Charges Dismissed
    Description:
Brian Gurwitz and I defended Mr. Baker who was charged with a felony strike residential burglary of an occupied dwelling. Toward the end of trial we discovered through cross examination of a Deputy Sheriff that a video tape existed that had not previously been turned over by the prosecution in discovery. This video clearly showed that two police officers had given false and misleading testimony at trial and when the prosecutor reviewed the newly discovered evidence, he concurred and immediately dismissed all charges against our client.
  • People v. Orozco (Felony Child Molest)

    Practice Area:
    Criminal Defense
    Date:
    Mar 12, 2010
    Outcome:
Client will serve 3 1/2 years instead of 275 years to life
    Description:
Mr. Orozco was charged with 6 counts of child molestation in Los Angeles Superior Court, several counts were alleged to have been accomplished by force. The DA had two charged victims and two prior victims alleging similar acts. The offer pre-trial was 275 years to life. After the first trial ended in a mistrial and the DA heard our defense, they offered Mr. Orozco a plea bargain before the second trial was about to begin that he willingly accepted. The negotiated sentence by myself and Brian Gurwitz will permit Mr. Orozco's release in 3 1/2 years.
  • People v. D.D. (AWF on Police Officers)

    Practice Area:
    Criminal Defense
    Date:
    Jul 05, 2011
    Outcome:
Not Guilty of Premeditated Attempt Murder of a Police Officer, Not guilty of Assault with Firearm on a Police Officer, Not Guilty of 2 Residential Burglaries, Not Guilty of Robbery. Guilty of the Lesser Crime: Assault with Firearm and False Imprisonment
    Description:
My client was 17 years-old at the time of this incident and was charged and tried as an adult for shooting an automatic rifle at Police Officers upon exiting an apartment where he was barricaded. He was also charged with various counts of Residential Burglary, Attempted Premeditated Murder of a Police Officer and Robbery. The Prosecution was seeking a potential sentence somewhere in the neighborhood of 65 years to life. Through the presentation of an effective defense, I was able to obtain Not Guilty verdicts on the 2 residential burglary counts, the robbery charges and both the premeditated attempted murder of a police and Assault with a Firearm on Police Officer charges. Rather than serve a sentence where he would have served a minimum of 45 years + and likely never have been released on parole, my client having been convicted of only the lesser charges we sought, will be released in 7 years, before his 25th birthday.
