    Description:
    Petitioner died prior to his wife and daughter being able to obtain legal residency. Prior to passage of the "widow penalty legislation" I was able to obtain legal residency for wife and child, even though wife had remarried and deceased petitioner was only a legal permanent resident.

    Description:
    Client's husband was the beneficiary of an approved labor certification and I-140 employer petition. Husband died in 2004 prior to being able to adjust. After President Obama signed new law in October of 2009 client became eligible to obtain residency through deceased husband's petition.

    Client was in removal proceedings when his wife became eligible to apply for residency based on her father's family petition. While Client's case was on appeal with the Board of Immigration Appeals, previous attorneys failed to properly file a motion to remand to the Board of Immigration Appeals. I filed a motion to reopen based on ineffective assistance of counsel and it was granted over the government's opposition.

    Client had a final order of deportation from 1996. He had a labor certification and I-140 petition approved. The government agreed to reopen his deportation proceedings and terminate to allow him to apply for adjustment of status with USCIS.
