    This type of case is called a Paternity case. Sometimes you can obtain a determination of paternity through the local child support agency but if you want to establish custody you will need to file a paternity case.

    If your spouse does not respond or file any response you may be able to proceed by way of "default" and obtain the divorce by default.

    First you must make sure that the country that the children are residing in is a signatory of the Hague Convention. Then you must also consider what place is the children's habitual place of residence.

    This depends on why the father is receiving SSI benefits but in any event this will not gain you any advantage in court.

    You should request a paternity test through the court to establish paternity. If the father is working you should be able to obtain child support.
