A truck hit me and the driver wants to pay me directly? But only wants to pay a particle amount.

Asked by a user in Fontana, CA - over 2 years ago.

You should make an insurance claim and receive all to which you are entitled. Plus, it should not matter what you do with the money. It is of no concern to him. You could take the money and spend it on what ever you like. Whether you fix your car or not is your choice not his. He is lucky you are being so nice. As always you should consult an attorney because there maybe other avenues that are available to you.

My child got a head injury in after school facility Can i ask theme to pay the ER. bill

Asked by a user in Palm Springs, CA - over 2 years ago.

You need to act fast. You did not mention a date of incident, but in most cases schools are public entities and as such you have a restrcited statute of limitations, generally only 6 months to file a claim. Consult an attorney now.

Can you sue a insurance company for leagal fees?

Asked by a user in Menifee, CA - almost 2 years ago.

In your situation, generally the answer would be no. Attorneys' fees are paid in cases brought through contract or statute. For example if there was a breach of contract and there was a provision in the contract that stated attorneys' fees would be paid to the winning party. Another example would be in civil rights violation cases statutes indicate that attorneys' fees would be paid as well. Auto Accident Cases do not fall within those two catagories.

What do I do when I can not get in contact with my lawyer?

Asked by a user in Riverside, CA - about 2 years ago.

When you went to thier office, did it appear they had moved? The California Bar Association makes it mandatory for any lawyer to update thier contact information, if he or she has moved they must update their current information within a couple of days. If they haven't moved, keep showing up until you get some attention. If that fails make a complaint to the state bar, that will work

I got in a car accident but i wasent driving but i got injured do i have a case

Asked by a user in Ontario, CA - about 2 years ago.

You most certainly have a case, regardless of whether you were the driver or passneger. You need to get the responsible driver's information. Seek medical attention immediately. If possible take photos of the car and of any visible injuries. If missing time from work get an off work note, and contact a personal injury attorney as soon as possible to get the best advice available. Good luck, and I hope you feel better soon.

I had e-stem done on my wrist and it burned my skin. now I can't use my hand or finish my therapy. can I take them to court?

Asked by a user in Murrieta, CA - over 2 years ago.

You did the right thing by taking photos of your wrist and seeking medical attention. Continue to do so (taking photos as the inhury heals/worsens). It does sound like something is there, but I would need more information. You could potentially have two different types of cases. First a medical malpractice case, for which you would need an expert medical opinion, and two a possible product liability case. In order to be certain I would need more information. You should seek legal help...

I was in an accident because my car was hydroplaning. Do I need a lawyer or have my insurance take care of it?

Asked by a user in San Bernardino, CA - over 2 years ago.

It is always better seek legal advice from an attorney. Most personal injury attorneys will give you free advice over the phone. I am sorry to hear that you were injured, and wish you a speedy recovery. Since you have "full coverage" your insurance will be able to take care of the damage to your car. However, you need to have an attorney review your insurance policyto make sure that in fact you are covered. If your insurance adjuster has indicated that they will take care of everything...

Wrongful death info

Asked by a user in Palm Springs, CA - over 2 years ago.

The earlier answer from Pamela is correct. I would add however, that if the wrongful death stems from Medical Malpractic then you have one year from the date you knew or should have known that malpractice occurred but in no event more than three years. Your best bet is to contact an attorney immediately so he /she can evaluate the facts and give you a very specific statute. Every case is fact specific. Do not delay. I would be more than willing to help you.
