What is Visa Issuance Fee? WHAT IS IT FOR?

Hello. I would assume this is for an I-130 for a relative living abroad. This is the fee that the State Department (national visa center) charges to process their case. They should charge $492 plus $88 for your financial affidavit of support. If you do not understand this stage, please feel free to contact us.

Can i reenter with new I-20 and old visa stamp (valid up-to july 2012)?

Fingerprinting and EAD

If you filed an i-765, then you will get a biometrics/fingerprint to get the EAD. It will take about 3 months to get the EAD.

Hello. If you are trying to be an employee of a company, you need them to sponsor you for a visa (likely H1b). However, you can form your own company with an investment and come over on an E2 investor visa. This will depend on the amount of the investment and activity of the business.

I want to divorce my husband of almost 3 years, but my mother is his sponsor...what happens?

If he has a 10 year green card, you divorce will have no affect on his Residency. It may increase the time he needs to stay to qualify for citizenship. Yes, you and your mother are still responsible for the I-864 requirements. This survives divorce.

Expired K1 Visa, Married but no AOS filed.

You are not in status and thus illegal. If you file your Adjustment based on marriage to him, you can get back into a safe status while your case is pending. But, if he does not agree or finish the case you may be denied. You have very few options on a K1, much less a K1 overstay. If you do not marry him, your only other option may be a spousal abuse case (if such facts exists).

Will my exisiting B1-B2 visa take over when my R1 is no longer valid? If so when does the 6 mo date of entry start?

Hello. It will not automatically happen. You can file for a change of status before your current R1 employment ends. You will need to pay the USCIS for this request. You must also provide sufficient proof of your B2 qualifications.

Hi-You need to be honest with your application even though there may be no record. They will take your fingerprints and verify it also. Try and bring any notices or tickets you did receive at that time in San Diego.

Wish to fix my legal status!

Unfortunately, there is no easy way to correct your status. If you were brought here illegally, you cannot obtain any status (unless the laws change). There is an existing exception that permits the filing of a penalty ($1,000), if you have had a previous family or employment based case filed by 04/30/2001. Has anyone in your family filed such a case? Otherwise, you must go through a consulate process and be subject to a 10 year bar if you marry a US citizen.
