Made motion to strike the 2 texas DUI's as they did not meet the requirments in California for priors that can be charged. GRANTED. Also challenged refussal as it was not shown he refussed at preliminary hearing. REFUSSAL DISMISSED. Original offer was plead to felony and stipulate to 16 months state prison. Now he is only faceing second time dui without a refussal as a misdomeanor!. The penalties for that in san diego are 96 hours custody, fine and multiple conviction program.

    My client ran off the road after exiting the fwy. witneses claimed that he was the driver and his wife the passenger. He was charged with a Dui and the .15 BAC enhancment. His wife was charged with a PC 148 (she became combative) Cops took finger print lift from steering wheel and drivers door as my client claimed he was not driving wife was. Cops ended up destroying the print cards. Mad a motiont to dismiss based upon destuction of evidence. Prosecutor offered wet reckless (lesser charge no DMV suspension) prior to judge ruling. Since we won the DMV client accepted. Lower fine, less probation, no license suspension, lower insurance, no dui conviction.

    Cop claimed he saw client drive past him without headlights on and when he got behind vehilce headlights came on. Independant witness testified he saw vehilcle coming toward him with headlights on. Pictures of scene showed that it was impossible for cop to see car coming towrad cop based upon cops location and 8 foot high wall obstructing cop view. Motion to supress evidence granted based on unlawfull stop. All observations and FST's and statmenst excluded along with test results of .15 BAC. Case dismissed
