  • I received a DUI in Humboldt County with a BAC of . 21. Is there really any point to hiring an attorney?

I have read on numerous legal advice sites that there is almost a 100% conviction rate at this level of BAC and, objectively, I was definitely in the wrong. I should NOT have been driving and was definitely a risk. What would be the TRUE advantage...

    Michael’s Answer

You should first consult with an attorney in your area and review the specific facts of your case. Most attorneys on AVVO offer as free initial consultation

    Michael’s Answer

You should consult with an attorney in state license issues. These sound like low level crimes and most likely will not prevent you from obtaining a salesman license. They will have to be disclosed and you will have to provide documentation.

  • Can a governor pardon be given for a dui that happen 2 yrs ago?

Had a dui 2 yrs ago and I'm trying to get my DUI expunge plus I heard that if you get a pardon you can still serve jury duty. How long is the process to get expunge? Will employers realize I had a DUI after I expunge it?

    Michael’s Answer

Your dui can be dismissed once you are off probation. If you are still on probation you need to make a motion to terminate probation early. That request along with the request to dismiss are discretionary with the court. You are NOT prevented from voting with a misdemeanor DUI conviction. Speak with an attorney in your area for full details on your case

    Michael’s Answer

It would be pretty hard to convict a person for "drugged" driving without any positive drug tests no matter the claims of the cops. Consult with a DUI attorney in your area on specifics

  • DUI...Upcoming Court..DUI Conviction

I was arrested on 7/15 for DUI, the arresting officer took a breathalyzer sample even tho I told him I didn't trust breathalyzer results and wanted to do blood test. He took me to ER to get a sample of my blood. I was released the next day on OR....

    Michael’s Answer

Your request us confusing. The DA can use the PAS results and other factors to set a bail amount. You are entitled to a bail review hearing. You should have had a lawyer appointed for you if you could not afford one and you are in custody. You should hire an attorney as soon as possible if you can afford one.

  • I was arrested in SB County yesterday for DUI .08. The officer had no probable cause and I had GERD outbreak that whole night.

    Michael’s Answer

You should immediately hire an experienced DUI attorney in Santa Barbara. Driving in a shopping center parking lot is not regulated by the vehicle code unless posted. It appears that you are correct in no OPC for the stop. A qualified attorney can determine the actual legality of the stop. Also the 08/09 breath test is defensible even without gerd.
