Need to hire attorney in orange county CA. to request an old expunged record removed off the county web site,

Asked by a user in Laguna Beach, CA - about 3 years ago.

First, check with the court to make sure the expungment order was actually entered and sent to the appropiate agency. You did not say where it showed up. Unforetunately with the internet access to old records from some sites and older information amy still be available on some public records.

Where to find B.A.C. from blood test after DUI? And Court Details

Asked by a user in San Diego, CA - over 2 years ago.

The easiset way tob get the BAC is, that the cop should have given you a print out if it was a breath test your level is listed as SUBJ. The other ways are to request a$ DMV hearing and get the polcie report from the DMV. This should be done in every DUI case to contest the Administration suspension. The DMV canonly suspend with a good documented test of 0.08% or greater. At the first court apperance the BAC will be available Really should consult an attorney

CA DMV was notified by AZ MVD of a DUI arrest in AZ, but CA DMV has interpreted the notice as a DUI conviction, what now?

Asked by a user in San Diego, CA - 6 months ago.

First, dont panic.Contact DMV mandatory actions in Sacramento. Generally these letters are a mistake and go out when the DMV is notified of a potential action in another state.

Questions about a Restricted License resulting from a DUI

Asked by a user in San Diego, CA - over 1 year ago.

You should be able to get your full license back on 12/24 as the DMV suspension and the court imposed suspension merge. You should have the 2 months credit against the 5 month restriction that you were susoended past the 30 days when you got your restricted license. Also, remeber to pay the DMV the additional $55.00 for the conviction imposed 6 month suspension and keep the SR-22 proof of insurance on file for 3 years to keep your license from being re suspended

I got my second DUI and failed to complete the DUI classes, will I be given a 2nd chance?

Asked by a user in San Diego, CA - almost 2 years ago.

Yes, youn will be given an re-referral for the program Generally the court will not impose additional sanctions for failure to enroll or complete for the first re-referral BUT make sure you have done everything else . Are you up to date with your fine payments?. Did you complete the MADD course?. DO not worry, the court will not put you in custody when you show up to clear the warrant However, you need to get the warrant cleared a soon as possible so you are not arrested on it. San...

I live in florida and have my first court hearing tomorrow in california. i cant make it. what do i do

Asked by a user in San Diego, CA - about 2 years ago.

Contact a well qualified DUI attorney in San Diego. On a misdemeanor DUI an attorney can legally make the "personal" court apperance for you. Most of the time the attorney you choose make all the necessary court apperances and handle the case without you present. Yo may need to be in court for some specific reason in the future if the attorney or the court believes your presence is required. Do not miss the court apperance and allow this case to go to warrant

Will a dui in georgia count as a dui in california?

Asked by a user in Los Angeles, CA - about 2 years ago.

Yes, it will count as a DUI in California for DMV purposes BUT may not count as a prior for criminal proescution. This is because the Vehilce Code allows "substaintially similar" DUI statutes in other states count for administrative license suspensions. However, the statute must be the same for criminal enhancment. In California we have what is known as a driving statute, a person must have driven a vehicle to be guilty. A number of other states have what are known as control statutes where a...

I got a DUI Oct 2000 and a second one May 2009. The local DMV and Sacramento told me my DUI will count on my record for 13 yrs??

Asked by a user in Glendora, CA - about 2 years ago.

Presently DUI's are proirable for 10 years from the date of offense to the date of offense. The October 2000 will fall off in October 2010. Unil that time you can be charged with a third offense. After October 2010 can only be charged with one prior, the 2009 May prior. However, a bill in the assembly AB 1601, which is expected to pass, will make All DUI and wet reckless priorable for life. So when that does pass, the 2000 and 2009 convictions will be chargable as priors making any dui a...
