What are the time limits on being required to carry SR-22 insurance in California?

Asked by a user in Sacramento, CA - about 3 years ago.

Call California DMV's Mandatory Unit in Sacramento to check on your particular situation. I do believe you will have to pay the reinstatement fee. Once Cali is cleared, you should be okay with WA. Do not do anything until the suspension period specified by California is over. Then if you really want to clear the California DMV without "waiting and seeing" if anything is reported in/by/to your home state, simply do the following: Apply for Termination of California DMV's Suspension...

I got cited for 647 (f) I have 2 DUIs and on Informal probation. PLEASE HELP!

Asked by a user in Placentia, CA - almost 2 years ago.

Just because you were "cited" does not mean the District Attorney will actually file criminal charges. You will know on your court date if 647(f) charges are actually filed or not. Sometimes they are not. If you are concerned, you really should go to www.dui-help.com and retain a local attorney to handle it. Many times he or she can deal with the Prosecutor in advance. Because of the probation cases, you may want to protect yourself asap by hiring a lawyer to fight for you.

CALIFORNIA law- Husband lets wife drive drunk any reprcussions to husband?

Asked by a user in Fremont, CA - about 3 years ago.

If husband pursued civilly, PI attorney will try to develop facts establishing: a) Husband knew she was an alcoholic and a danger if she drove; b) Husband could have stopped her from driving but did not, even though he knew she was drunk that night; c) Husband negligently failed to control his spouse under circumstances which he could have. Whether any of the claim would fly remains to be seen.

How do I preview the evidence againts me after being arrested for a dui.

Asked by a user in Oakland, CA - about 1 year ago.

Your question is excellent. You reasonably wish to review and analyze all of the State's discovery / evidence including but not limited to the arrest report, the BAC test record (not just the result; the result may be high but the record may be legally inadmissible at DMV), any PAS test results, the DS 367 (Officer's sworn Statement), and all other documents (some of which can also be subpoenaed). Your DMV Attorney can request that discovery, as long as the request is made within...

I was charged with a DUI and unsafe lane change.

Asked by a user in Los Angeles, CA - almost 2 years ago.

Since VC 23140 is NOT a DUI (it's .05% or more), an infraction like the 21658 charge, you are probably safe from prosecution unless a) you had another citation and/or date for appearance, b) BAC over .08% and DA reviewing it (DA has up to one year from date of offense to file charges resulting in issuance of complaint and which still may be barred from prosecution; if filed contact a lawyer near you at www.dui-help.com), or c) other unusual situation not covered by limited facts above. As...

When on probation for a 1st DUI, if busted for driving with between .01-.07, is it a probation violation or a second DUI?

Asked by a user in Los Angeles, CA - about 2 years ago.

Here's the answers to your two questions in the small text: 1. PV (Probation Violation, Vehicle Code Section 23154). 2. Not accurate. Don't believe everything you hear. DMV & Court issues & problems with new .01% BAC probation law At DMV, for those who test at .01 or higher: Although the Legislature amended CVC 13353.2(a), operative January 1, 2009, to include CVC § 23154 violators, it neglected to amend CVC 13557(b)(2)( A) and (B) to include CVC § 23154. As such, unless and...

DUI Reduced to Wet Reckless in 2007, 3 yr prob. over possible to expunge?

Asked by a user in Los Angeles, CA - about 2 years ago.

Can one get a job as a paralegal with a misdemeanor dui conviction?

Asked by a user in San Diego, CA - almost 2 years ago.

In my line of work, I might find it helpful to have a paralegal with firsthand experience. The personal observations made during the investigative and arrest processes may be a bonus for any paralegal working for a DUI criminal defense attorney. While DUI criminal defense lawyers try to recreate nights in question, a defense firm may find it instrumental to have someone who has actually been in the shoes of an accused.
