If your question is whether you can now file the bankruptcy petition, the answer is no. If the business was a corporation or LLC, the petition could be filed by a new officer. However, since the business was a proprietorship, only your mother could file. It seems to me that the real question is whether there is any titled property that any judgment liens can attach to.
