    Assuming that important issues will be decided in your case, an attorney should be hired to help you prepare for the trial or appear for you then. The caveat is that this should be done well in advance of the trial date in order for you to achieve the best result. If the trial is too close, many lawyers won't take your case or be able to really help you because there won't be enough time to prepare adequately.

  • Served Legal Separation...want divorce

    My soon to be served me with legal seperation paperwork. The problem is that I want a divorce! Can I respond on the FL-120 divorce rather then legal seperation? If not do I have to file a petition myself for dissolution? Need help.

    Yes and in the end your request should be granted since you are entitled to a Dissolution of Marriage by law.

    Since the order in July was by Stipulation, it is my opinion that the court can go back and look at past behavior.

  • Family Law Trial. Judge orders both to file/serve briefs 10 days prior to hearing. I was served after 10 days. What can I do?

    File/serve brief after the 10 day Judge order

    At the hearing you should mention it to the Judge. You can ask that it not be considered but probably the best you can do it obtain a continuance if you haven't had a chance to fully understand and consider the points being made in the brief.
