    It sounds like your son may not be at fault. I would not pay them based on what you stated. You may want to discuss the facts further with a local attorney. Otherwise, it is a small claims matter and if they proceed it will be up to the Judge to decide who is at fault.

    If you have insurance the insurance company will defend any action against you. If you do not have insurance and the damages are substantial that he is trying to recover and you have nothing, bankruptcy will wipe out any judgment against you.

    I doubt if either are going to pay for your damage to your vehicle. If you have collision coverage you should submit the claim to your insurance company. You are not entitled to compensation for your grief and the time away from your family. Your only possible recoverable damages are $1,000.00.

    It sounds like it was not your fault. Therefore, contact the other person's insurance company and have them pay to fix it and pay for a rental car while your car is in the shop.

    No they can't recover against you unless there was some type of negligent entrustment that they can prove. You should talk to a personal injury attorney right away. Regarding going to jail it depends, you should talk to a criminal attorney or the public defender.

    No they will not advise you. Every thing you say to them they will keep record of to protect their interests. Find an attorney to assist you in this matter. The insurance company is definitely not your friend.
