    Sign the quitclaim if he was awarded the property in the divorce. He cannot refuse to pay you spousal and child support if the court order says he is supposed to pay it. I agree with my colleagues though that this is the type of situation where cooperation will likely yield better results than running back to court; especially since you've already been divorced two-years. Why prolong this any more?

    This is a tough situation. You should hold her accountable to seek a job by asking the court for a seek-work order. If granted, she would have to report the efforts she is making in seeking a job.

    You may not be liable IF there was a clear date of separation three years ago. Of course, your spouse may claim that you never separated in order to hold you liable for 1/2 of the debt. It is best to file for dissolution or legal separation if the marriage is over to protect yourself from future liabilities.

    I am in the process of divorcing my soon to be ex husband. We have 3 children together I am not requesting any kind of child or spousal support from him because he has never held down a job so do I still have to file for the FL-150?

    You still have to exchange financial information with your husband within 60 days of filing the petition and the summons. However, you do not have to file the FL-150 with the court; just the declaration of disclosure that says you served it upon your husband. This is regardless of whether you are seeking support of any kind.

    You need to serve a Deposition Subpoena upon her bank or submit Form Interrogatories or Request for Production of Documents to your spouse. Keep in mind the time constraints you may face depending on when the RFO is scheduled as your spouse or the bank will have 30 days to respond and if your RFO is before that, these documents will not help. You may ask opposing counsel to stipulate to a continuance or provide you the documents ahead of time.

    You would be better served hiring a lawyer to represent you in this process because your spouse is represented and you may be at a disadvantage.

    If you are concerned about your spouse leaving with your children, you should file for divorce or legal separation asap. Once the papers are filed and she is served, automatic restraining orders go into place that prohibit the parties from moving the children out of the state. You should speak to a lawyer asap.

    Spousal Support is based on several factors and is in the discretion of the court. That being said, you seem to have some favorable factors in your case. You mention you have kids, so there may be issues involving child support and custody if they are minors. You should definitely speak with an attorney in detail about your case and start the divorce process. Nothing will be handed to you unless you enforce your rights.

    Will take anywhere from 4-6 months. You will only received the EAD if your application is approved; then you will have to apply for the SSN yourself.
