This sounds like a good probable cause matter. Sitting in a car which is not operating (if its your car or your parents car) is not much different than walking down the street. I am assuming that you had permission to be there, and were not under suspicion of auto burglary or auto theft. However if you never operated the car and if it was impossible to operate the car, you also have a fact defense. Get a local criminal attorney immediately and get the facts into an affidavit after the...

Ignoring any holding company problems on a company holding shares, remember that the California minimum franchise tax of $800 will continue to accrue forever and although the corporation is supposed to be responsible, rather than the members, (see Ralite), why is the LLC still alive if its not doing business? What happened in 09, 10? Are you running into the future with only a divided $800 loss? Has this corp stopped business? Hopefully there are no sales tax issues which might attach...

You gave a well constructed question. Hey guys I just went to the hospital recently and the bill is around 14 grand. I can't pay because I have no job, so I was wondering if I could get the hospital bill waived. If you can convince them that you will not pay it, they might. Who knows what they are thinking. My question is if I am successfull of getting my bill waived do I have to fill an income tax return next year even If i don't have no job? Job has nothing to do with it. Its...

Reputation in that you have a good reputation for truth, for following the court's rules and so with the bar, the public and the judges is ok so long as it does not imply improper influence. More important, are there appealable issues? More importantly, is the attorney you select of sufficient experience to be a specialist. I am on the board of specialization. I will refer you to two sources for validation. The first is the list of appellate specialists in California. The link is...

This is a problem that the Non Profit subsection of the Tax Section of the California Bar has been urging the government to change for a long time. Any for-profit corporation can use Internal Revenue Code (IRC) provisions 300 et seq. to reorganize in a different state and take all their old attributes. With 501's, when you start in another state, you start all over again, including applying for 501(c) status afresh. The real question is why do you want to move it? You can ease the...

But if you are an adult, it still stays on your record, and it can form a basis to be used in other, further convictions. I don't consider it awesome. Being not arrested, not charged, not tried, and found not guilty; these things are awesome.

You didn't mention the strength of the case, or whether there are others involved, whether you had been indicted yet. Nor how long you have been living in Mexico, AND whether or not the IRS might also be involved (and whether or not the activity and its profits have been timely filed on a return). Don't answer the above. These are factors to consider on strength of case (which you didn't give an opinion). Hire an attorney without delay

Why would you want a wedding in Cuba if your father could not go? Conversely, why would you want to get some assurance that he could go and return, given that government can LIE-LIE-LIE? Unless you want father to be stuck in Cuba? Why are you even considering such a move? If it blows up, it mayl be almost impossible to fix, so, are you good personal friends with the Obamas? If the Obamas attend the wedding and travel with your contingent to Cuba, you have a better chance of having it...

Have you considered addressing your assets to help you hire a lawyer? If convicted, it will impact the remainder of your live severely. Possibles include sale of assets, refinancing assets, borrowing from others, and much more. Having zero arrests and jail time thus far is a trial advantage that many people do not have. My impression is that people tend to take a plea rather than give up their assets and don't see how damaging it can be. Other factors may include whether you are a medical...

    1. If you are moving forward, always ask for reconsideration and tell the judge why. Why? Because you give him a chance to reverse/give a directed verdict after having heard the reason. AND it shows that you have exhausted all remedies AND it gets the fact on the record. Talk to your attorney about this. 2.
