  • Can I still get a Divorce while she's going Thru Bankruptcy Chapter 13?

    I've been trying to get it over but she filed for Bankruptcy Chapter 13. Is there such a thing as lift of stay to get the Divorce done?We've been Separated 3years and I Have to Pay the IRS.

    You don't need to file motion to lift stay for proceeding with dissolution of Marriage during pendency of chapter13 by separate spouse.
    Not sufficient information regarding your issue of IRS debts. Either you work out a plan with your spouse regarding repayment of debt through her chapter 13 by contribution or you have your own plan with IRS to pay it outside chapter 13 or in a chapter 13 plan. It depends, how much is the outstanding amount, If IRS taxes owed for priority taxes or unsecured non-priority claim, your income and ability to be able to qualify for chapter 13 plan eligibility.

    Yes will all attachments as per rules. If you have problem with your EX posting vulgar things, you can request the court to issue restraining order against her , prohibiting her from such publications on social media.

    Go back before the traffic court judge and set up payment plan in the traffic court or seek allowance of community service in lieu of find. Pay minimum amount to get the abstract issue. I think, if you speak with the traffic court clerk can guide in right direction.

    You can put unknown, since, mom is also required to file her income and expense statement along with copies of recent paystubs, to assist court in commuting support payment.

    You can send her demand for production of documents concerning her monthly income and income tax returns to verify her income from all sources

    You can file chapter 13 for auto loan. But you may not be able to change the interest rate, in order to modify auto loan interest terms and strip the auto loan to adjust payments, , you need to wait for at least 910 days from original loan date. May be after 5 more months, you can reconsider the option of refiling.

    Its been 180 days, you can set up appointment with info pass and see the officer at district office and check into status of the case. Hiring and experienced attorney and having him check into status of case, may help further in moving this case along. Good luck

    You can try getting your driver license with the N-400 Notice of receipt from USCIS.

    Its helpful, if you can review your case with an experienced family law attorney. Review court file. Look at the judgment, if the judgment has terminated court jurisdiction to award spousal support.

    Also, examine, income and expense , other party filed in court. You can file for OSC re: spousal support, support issues are never final, unless court terminated its jurisdiction to award spousal support to affected party. My recommendation would be to consult and attorney immediately without delay, since, time lapse could be essential factor.
