Don't plead guilty. This is a silly charge based on bad business practices. I would be shocked if any prosecutor would want to try this case. Paying the cost of repair for a complete dismissal seems appropriate. Having any type of theft conviction on your record based on this incident would be tragic. Fight this all the way.
What was the small object? A penny, golf ball....? The facts make a difference. Was the act coupled with threatening words and damage to the vehicle? Did it cause the car to swerve? Was the driver a girlfriend or someone you previously dated? These things are very important to know as other charges could be filed. Also, most attorneys accept payments...call around.
Your brother is in a tough spot. First, regarding deportation...he may be deported and maybe not. He'll be seeing an immigration judge after he serves his time on the criminal case. You should contact an immigration lawyer for his deportation issues. Bail: $100,000 is high, but the bodily injury must be severe and....does your brother have a criminal history and/or a history of failing to appear. There are many reasons why the bail could be set high. How much time he does in jail depends...
As long as there are no outstanding fines and you have completed the terms of probation then you should have no problem getting probation terminated early. Once terminated then we file for an expungement. Of course, any request for an expungement should be coupled with an attached declaration with exhibits.
What he is offered depends on his record, the prosecutor and the judge. Obviously striking the strike and getting the robbery reduced to a grand theft person is ideal but probably not likely. If he has no money and he is in custody then he needs to go with the public defender.
Some tickets slip through the cracks and some don’t. Generally, being on informal probation is easier because there is generally no assigned probation officer reviewing your arrest record. A marijuana ticket is such a minor offense that a judge should ignore it. On the other hand, you might get a judge who will give hou the maximum for any probation violation. Find out about the courthouse and judge who is likel tol hear your probation violation and...yes..hire a lawyer
Possession is always better than a sales charge. It can be explained better and there is more sympathy for drug users versus drug dealers. Your ability to get a state license depends on what type of license you are seeking. Child care license....probably not.
It depends on who you ask and the nature of the crime. Many families do actively call the prosecutors to request a charge be dropped, reduced or enhanced. Family and victims have the right to speak before the judge prior to sentencing (Victim Impact Statements). Civil Compromises aloss D. A. Continuances where money is paid for the victim's loss are common.
Expungement is always worth it. However, filing the documents is never a guarantee that it will be granted, and some prosecutors routinely object. I don't know why. Petty Theft is a very lightweight offense so you shouldn't have a problem.
Did you successfully complete probation? Have the fines been paid? Do you have any pending cases?
