Depending on your UM policy, you should be covered. If there is no police report, file one! Call an attorney for immediate advice and do not talk to your insurance carrier before Speaking to an attorney. Had a similar case and settled for six figures. Tread carefully.

  • What should I do to sue this owner or driver?

I was driving straight on a street with a speed of 35-40 mph. There was a car making an unsafe left turn to another street. He did not yield for me. At that moment, I tried to break as hard as I can, but I couldn't stop the car. I hit his car on ...

    Hadi’s Answer

Several ways to approach this. Request the police report. Get treatment for your injuries immediately. If you do not have health insurance, speak to an attorney. Finalize treatment, then submit a demand. The above is all based on what coverages the insurance policies (your UM, the third party Carrier, or that idiot that ran away - if caught) cover. Tough hill to climb on your own. Hire an attorney and let him/her handle this matter.

  • When claiming physical or mental damage, does it have to be permanent damage or could it be temporary? If I felt dizziness but

recovered, can it be a valid damage claim although it's temporary?

    Hadi’s Answer

You can claim both permanent and temporary damages. Of course it's easier to prove your claim if you have supporting documentation such as medical records, pictures, witness statements etc. However, prosecuting your own case without legal representation is reckless. Consult your case with an attorney.

Need to file a SR 1 and then ST 19. File a claim with your own insurance company and later recover your damages from the other party's insurance company for your own cars Diminished Value, Loss of Use and rental reimbursement. Pretty complicated but its easy if you graduated from law school and obtained your CA Bar license. Good luck.
