The matter was referred to the immigration court. The immigration judge granted client asylum protection because an individual who has been identified as homosexual and persecuted by his or her government for that reason alone may be eligible for relief under the refugee laws on the basis of persecution because of membership in a social group.

Shortly thereafter, client was arrested for willful infliction of corporal injury on a cohabitant in violation of section 273.5(a) of the California Penal Code. A possible conviction would seriously put client's green card in jeopardy as a conviction resulting in the imposition of a term of imprisonment of 1 year would render client removable as an alien convicted of a “crime of violence” (aggravated felony offense). Through my office, the DA agreed to drop the charges once the client completed 52 spousal abuse courses. Client's green card is no longer in jeopardy.
